I’ve heard a wide range of stories about OSHA inspections-the bad and the good.  But the one thing I hear that makes me cringe is when an owner tells me that he is exempt from OSHA.

Of course, there is a list of OSHA exemptions-and chances are, you are not on it.

1.  Public Employees.  This includes federal, state, county, city, and township employees.  A private contractor and city employees could be working the same type of job, in the same conditions, on opposite sides of the street.  The private contractor is under the OHSA umbrella, while the public employees are exempt.

2.  Employee groups that are under the jurisdiction of another federal agency.  This includes mining operations, ships at sea, and flight crews while they are in the air.

3.  Family members working on a family owned farm.

4.  Volunteers.  This is a person who receives no compensation and is not on your company’s roster.

Finally, the exemption that creates the most confusion amongst owners in our industry-

5.  A Sole Proprietor with no employees.  If you have no employees, then by definition, you are not an employer.

What this means is that you are an owner with ZERO payroll.  This has confused some, because some believe that if they are an owner, and are working alone in the field, then they do not have to worry about an OSHA inspection.  However, they may pay someone to answer their phones or estimate jobs.  This is easy to overlook, because this employee has no exposure to any job related hazards.  Make no mistake, if any person is on your payroll, you are not OSHA exempt.

The Public Utilities Commission of Ohio (PUCO) recently rescinded administrative rules applying to private commercial motor vehicles with a gross vehicle weight (GVW) between 10,001 and 26,000 pounds operating in intrastate commerce.

The PUCO hosted a series of listening sessions across Ohio this winter to gather input from affected carriers about the operational and financial costs of compliance with the rules. Based on feedback from interested parties, the Commission rescinded the rules while changes are considered. As a result, roadside educational stops for affected carriers will no longer take place.

The PUCO staff will file a report with the Commission by June 14, 2011 containing an analysis and recommendations for possible future rule amendments. Staff will take into account Gov. John Kasich’s Executive Order 2011-01K “Establishing the Common Sense Initiative,” which accounts for the impact a rule has on small businesses.

• The PUCO publishes the Motor Carrier Safety Rules Handbook to assist motor carriers and drivers understand which safety regulations apply to them.
